Alvarez Marketing Solutions ("Company," "we," "us," or "our") operates the SPRKLaunch platform ("Platform"). We are committed to protecting the privacy of our clients and handling personal information with care and transparency.

2. Information We Collect

2.1 Account Registration Information

When you sign up for SPRKLaunch, we collect the following information:

       First and last name

       Business name

       Email address

       Phone number

       Business mailing address

       Payment information (processed and stored securely through Stripe; we do not store full payment card details on our own systems)

2.2 Setup & Onboarding Information

When you purchase a Charm or bundle that requires the Company to configure platform features on your behalf, we may collect and temporarily access additional information necessary to complete that setup. This may include:

       Social media account credentials or delegated page/account access (e.g., Facebook, Instagram)

       Google Business Profile access or Google account credentials

       Payment processor credentials or API keys (e.g., Stripe, PayPal, Square, Shopify Payments)

       Business branding assets such as logos, brand colors, and photos

       Other third-party platform credentials or access tokens as needed for specific Charm or bundle setup

 

Important: Setup credentials are used solely for the purpose of configuring your platform features. They are not stored beyond what is necessary to complete setup and are never shared with third parties. You should revoke or update any shared credentials after setup is complete if your security practices require it.

2.3 Platform Usage Data

We may collect data about how you use the Platform, including:

       Features accessed and actions taken within the Platform

       Login activity and session information

       Device type, browser type, and IP address

       Error logs and performance data

2.4 Communications

When you contact us via email, through the Platform, or through any other channel, we retain records of those communications including the content of your messages and your contact information.

2.5 Your Clients' Data

When you use SPRKLaunch to manage your own business, you may upload, import, or generate data about your own clients and contacts within the Platform ("Client Contact Data"). This may include names, email addresses, phone numbers, purchase history, and other contact details.

We do not access, use, or process Client Contact Data for our own purposes except in the following limited circumstances:

       When you request our assistance with a Platform feature or setup task that requires us to access your account.

       When required to troubleshoot a technical issue on your account.

       When required by law or to protect the rights and safety of the Company or others.

 

You are the data controller for your Client Contact Data and are solely responsible for ensuring its collection and use complies with all applicable privacy laws.

2.6 Website Tracking & Analytics

Our website uses tracking technologies including cookies, pixels, and analytics tools to understand how visitors interact with our site and to support our marketing efforts. These may include:

       Google Analytics, which collects anonymized usage and traffic data

       Meta Pixel (Facebook/Instagram), which tracks website visits and conversions for advertising purposes

       To send you marketing communications about SPRKLaunch, including new features, Charm offerings, tips, and promotional content (you may opt out at any time)

       To monitor Platform usage for security, fraud prevention, and technical performance

       To comply with applicable legal obligations

       To enforce our Terms of Service and other agreements

       To use testimonials, results, and feedback you share with us in our marketing materials, as described in our Terms of Service

 

4. How We Share Your Information

We do not sell your personal information. We may share your information in the following limited circumstances:

4.1 Service Providers

We share information with trusted third-party service providers who assist us in operating the Platform and our business. These providers are contractually obligated to use your information only as directed by us and to protect it appropriately. Current service providers include:

       Stripe — payment processing and billing

       GoHighLevel — the underlying platform infrastructure on which SPRKLaunch is built and hosted

       Google — analytics and website performance tracking

       Meta — advertising and conversion tracking

4.2 Third-Party Integrations You Authorize

When you connect third-party services to your SPRKLaunch account (such as your payment processor, Google Business Profile, or social media accounts), information may be shared with those services as necessary to enable the integration. You authorize those data transfers by connecting the service.

4.3 Legal Requirements

We may disclose your information if required to do so by law, court order, or government authority, or if we believe in good faith that disclosure is necessary to protect the rights, property, or safety of the Company, our clients, or others.

4.4 Business Transfer

In the event that Alvarez Marketing Solutions is sold, merged, or transfers its assets to another entity, your information may be transferred as part of that transaction. You will be notified of any such change via email.

 

5. Data Storage & Security

Your data is stored on secure third-party cloud infrastructure. We take reasonable technical and organizational measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. These measures include encrypted data transmission, access controls, and secure credential handling.

However, no method of transmission over the internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your information, we cannot guarantee absolute security.

Setup credentials (such as social media logins, API keys, and platform access tokens) that you share with us for Charm or bundle configuration are handled with strict confidentiality. We recommend that you update or revoke shared credentials promptly once your setup is complete.

 

6. Data Retention

We retain your account information and Platform data for as long as your subscription is active. Upon cancellation or termination of your account:

       We will email you a copy of your contact/client list prior to account closure.

       All other data associated with your account — including automations, funnels, websites, forms, campaigns, and conversation history — will be permanently deleted.

       Billing records and transaction history may be retained for a longer period as required by applicable law or for legitimate business purposes such as dispute resolution.

 

You are responsible for exporting any data you wish to retain before your account is closed. The Company is not liable for data loss following account termination.

 

7. Your Rights

Depending on your location and applicable law, you may have the following rights regarding your personal information:

       Access: You may request a copy of the personal information we hold about you.

       Correction: You may request that we correct inaccurate or incomplete information.

       Deletion: You may request that we delete your personal information, subject to legal retention requirements.

       Opt-Out of Marketing: You may opt out of marketing emails at any time by clicking the unsubscribe link in any email or by contacting us directly at [email protected].

       Withdraw Consent: Where we rely on your consent to process your information, you may withdraw that consent at any time. Withdrawal of consent does not affect the lawfulness of processing that occurred before withdrawal.
